In a BMC property-damage matter involving a broken vehicle mirror, Patrick represented a client who had struck the mirror with his hand. After several clerk-magistrate hearings, Patrick persuaded the clerk to resolve the matter through restitution. The client paid for the damage, the application was dismissed, and no criminal complaint issued.
In a separate BMC Central matter involving an allegedly fraudulent driver’s license, the clerk found probable cause. Patrick nevertheless argued that a criminal complaint was unwarranted in light of the client’s circumstances and the impact prosecution would have on his life. The clerk declined to issue the complaint, and the client avoided arraignment.
These cases illustrate why a hearing deserves preparation even when the allegations present difficult facts.
